Terms and Conditions Section X enumerates specific conduct which is prohibited on the Joystick Platform. In addition to those enumerated prohibited actions, the Joystick Platform has a Community Guidelines. This Community Guidelines forms an additional part of the Term and Conditions. By using the Platform, you agree to abide by and be bound by this Community Guidelines. Any breach of this Community Guidelines is a material breach of the Terms. Any material breach may result in action against the account holder, including immediate account suspension or termination, or a lifetime ban from the Platform. Actions against an account or account holder does not limit Joystick’s ability to pursue other civil and criminal legal actions depending on the nature of the violation.

1. User Conduct

   By using the Joystick Platform and/or registering an account on the Platform, you agree that you will comply with the following:

   1. When using the Platform, you will follow all applicable laws and not use the Platform for any unlawful purpose, including without limitation any use that would subject us to criminal or civil liability.
   2. If you have registered an account, you will not allow anyone to have access to your username, password or stream key. You will also take affirmative steps to maintain the safety and security of your login, and stream information to prevent any unauthorized access.
   3. You are entirely responsible and liable for all activities conducted through your Account when interacting with others on the Platform and our community forums.
   4. You will not transfer your Account to any other person.
   5. You will not use or attempt to use any other Community Member's Account.
   6. In addition to the Terms and Conditions Section X prohibition regarding content that is unlawful, infringing, defamatory, harassing, threatening or abusive, you will further not share, request, or even discuss such content. These prohibitions including any content that is racist, sexist, transphobic, ableist, derogatory or otherwise offensive.
   7. You will keep all information contained on or provided to you through the Platform as private and confidential. You will not give such information to anyone without the permission of the person who provided it to you.
   8. You will not record or otherwise capture any of the content shared and/or streamed by any other user of the Platform for any reason.
   9. You will not use the Platform to infringe any privacy right, property right, or other civil right of any person.
   10. You will not use the Platform to illegally obtain, create or distribute unlawful copies of copyrighted material, including without limitation posting materials you do not have legal right to or requesting materials that the party you are requesting them from does not have any legal right to obtain.
   11. You will not attempt to or take any action to mask your identity, including but not limited to using fake or doctored profile information, faked headers or other mechanisms used to conceal the source of any communication.
   12. You will not enhance an account, including creating false impression of traffic to your account or content or artificially increasing follower count.
   13. You will not create additional accounts for any purpose including in an attempt to circumvent a ban by us or another Community Member.
   14. You will not use the Platform to send, request, or even discuss any obscene materials, including without limitation child pornography and any materials offensive to a person's dignity.
   15. You will not allow any person below the Age of Majority to appear in any Community Member Content.
   16. You will not allow any person below the Age of Majority to access or use the Platform.
   17. You will not use the Platform to obtain personal data or usage information of any type, including but not limited to the use of automated tools such as robots, crawlers or other data mining tools to collect data.
   18. You will also not post any links to third party site, or introduce in any way to the Platform, any malicious code.
   19. Commercial exploitation is prohibited, including the sale, reproduction in any manner, or link to (including framing the site in any other website or content regardless of whether proper attribution is given) any Community Member Content, communication made within the Platform or any portion of the Platform. You will only use the Platform for your personal enjoyment.
   20. You will not take any actions which directly or indirectly violate our Privacy Policy. You will not reveal any personally identifiable information about any Community Member or request any such information.
   21. Offers, discussion or arrangements for prostitution, escort services or any other type of compensation for meeting type arrangement is strictly prohibited.
   22. While Independent Broadcasters may exchange information with Community Members, including contact information, Independent Broadcasters may not use Community Members' information to provide webcam shows or receive payments outside of the Platform. If an Independent Broadcaster sells something to a Community Member or enters into any other transaction with a Community Member, the sale must be completed in exchange for tokens through the Platform.
   23. You will not advertise other websites that offer live webcam streams. Community Members may mention their own personal profiles, homepages and wish lists.
   24. You will not make any statements, or cause or encourage others to make any statements, which defame, disparage, or in any way criticize the Platform or the Company.

2. Rules for Community Member Content

   All Community Members are required to adhere to rules with respect to Community Member Content. The following acts/content are strictly prohibited, and no Community Member may post or broadcast these on the Platform or solicit any other Community Member to post or broadcast the same:

   1. Obscenity, including without limitation any actual or simulated scatological, rape, incestual (and depictions of incest), child pornography (or any depiction of child pornography), bestiality, and other actions or materials which may be deemed obscene or illegal in your community.
   2. Depictions of actual or simulated illegal and unsafe actions, including but not limited to violence, blood, torture, pain, erotic asphyxiation, rape themes, or any actions associated with causing physical or emotional harm.
   3. Illegal drugs are strictly prohibited, including drugs that may be perceived as illegal in certain locations, (e.g. marijuana).
   4. Promotion of fraudulent or illegal schemes or conduct of any kind, such as illegal money-making schemes, illegal gambling or betting, are strictly prohibited.
   5. Objects may not be used as sex toys unless they are normally marketed and sold for that purpose. If you use any type of mechanical device, it must also be marketed and sold as a sex toy and you use the device at your own risk and waive and release of liability for the Platform.
   6. Child pornography and depictions of minors, whether actual or simulated, on the Platform and in any Community Member Content is strictly prohibited. You cannot have minors in any content nor in the room when creating any content. You cannot role play minors and you cannot discuss minors on any content. If you breach these prohibitions, we will immediately report you to NCMEC and any and all law enforcement that we consider appropriate in our sole and absolute discretion.
   7. You may not perform while intoxicated, whether from alcohol or any drugs, including prescription, legal or illegal.
   8. You may not engage in any offensive and/or degrading conduct including but not limited to the use of degrading or verbally abusive dialog or offensive roleplay such as ethnic or racial roleplay.
   9. You may not broadcast from any public place or in an area visible from neighboring property, or from a studio or set that creates the impression that the Independent Broadcaster is in a public place.
   10. Community Members may not broadcast, upload, or offer any content including, referencing, or depicting menstruation, vomit, feces, or urine.
   11. You may not broadcast while sleeping, or pretending to sleep for any length of time. You must be awake during all live, previously recorded streams, or any uploaded content.
   12. You may not actively link to or promote direct competitors in a manner to direct viewers away from Joystick through any means including displaying links on stream, in chat, or through profiles unless otherwise permitted by JoystickTV staff.
   13. You are responsible for any and all voice, audio, or recording that may appear on your live streams and media. All persons and voices must adhere to the User Conduct, and may not use language deemed as, but not limited to, racist, sexist, transphobic, ableist, derogatroy or otherwise offensive.
   14. You may not broadcast previously recorded streams as your sole content. All streams must be live content, and the broadcaster must be present during the stream with the exception of taking breaks.
   15. You are not permitted to step away from the live stream or chat nor ignore chat for extended periods of time. Broadcasters must end their stream if the break period is to exceed 30 minutes or longer.
   16. You are not permitted to stream the content of another broadcaster's live stream except for when both parties have given by consent using the necessary tools provided by JoystickTV or approval by Joystick staff.

   These lists are not necessarily exclusive. At any time, we may prohibit any activity we determine, in our sole and absolute discretion, to be inappropriate. We may to terminate or suspend your access to all or part of the Platform at any time, with or without notice, for engaging in any inappropriate activity determined in our sole discretion.
